The Draycote Water Sailing Club Limited

 

REGULATIONS made by the Committee of the Club under the authority of the Rules relating to the management of the Club and the conduct of members and visitors.  Strict observance of these Regulations is required of members and visitors as most of the regulations are conditions of the lease and licence from the Severn-Trent Water Authority to the Club.  A failure to comply with the Regulations is a breach of the undertaking given on joining the Club and will render a member liable to expulsion in accordance with the Rules.

 

DEFINITIONS

For the purpose of these Regulations the expression “Club’s premises” shall include the clubhouse, boat and car parks, slipways and foreshore, the Water and all land leased to the Club or over which the Club has any rights:  “Water” means the reservoir owned by the Severn-Trent Water Authority know as “Draycote Water”.

 

The Draycote Water Sailing Club Limited and its Officers do not accept any liability howsoever arising out of the use of its premises or Water by members, their guests or affiliated groups.

 

1.0    General

1.1    Opening Times

The Clubhouse shall be open during such hours as may be from time to time decided by the Committee.

 

1.2    Complaints

Any member having any complaint to make about the conduct of any club servant, or any defect in the Club premises or grounds or about any breach of the Rules or Regulations, shall make the same in writing to the secretary, in order that it may be submitted to the Committee, whose decision shall be final.

 

1.3    Advertising

Books, periodicals, pamphlets, newspapers, advertisements and notices shall only be placed in the Clubhouse by permission of the Committee.

 

1.4    Food and Drinks

Members may consume food or drink brought by them to the Club in the Wet Bar area of the Clubhouse.

 

1.5    Radios

Personal audio equipment shall not be played out loud to the detriment of others enjoyment of the Clubhouse or the Club premises

 

1.6    Loose Clothing

Loose clothing or sailing gear shall not be brought into the bar, lounge, dining area or hall of the Clubhouse.  Clothing left in other parts of the Clubhouse will be collected every Sunday night and disposed of after two weeks.

 

1.7    Wet or Soiled Clothing

Members and visitors wearing wet or soiled clothing or footwear shall not use the Bar lounge or Dining area of the Clubhouse at any time.  Members and visitors when using these areas are expected to be reasonably attired.

 

1.8    Functions

No function may be arranged to take place in the Clubhouse without the consent of the Rear Commodore House.

 

1.9    Club Property

No member or visitor shall remove from the Club premises or shall damage or deface any article or property belonging to the Club or for which the Club is responsible.  In the event of a breach of this regulation the member concerned, or responsible under The Rules for the visitor concerned, shall bear the cost of repair or replacement of such article or property as the Committee shall determine.

 

1.10 Visitors

No visitor to the Club’s premises shall be permitted, except as provided in the rules of the Club.  The member responsible for the visitor shall enter the name and address of the visitor and his own name in the book kept for that purpose on the Club’s premises.  (Affiliated Groups see Rule 6.10).  full Members may bring a maximum of two guests on four days in any one membership year.  The same person may not be introduced as a guest by any member more than four times in any one membership year.

 

1.11Children under the age of 14

Children under the age of 14 shall at all times when on club premises be under the control and the responsibility of a member or member of staff".

 

1.12 Dogs

No dogs, or other animals or pets belonging to members or their guests shall be allowed in the Clubhouse or anywhere on the Club’s premises or elsewhere on Draycote Water on lands owned by the Water Authority.

 

1.13 Boat Parking

Draycote Water Sailing Club reserves the right to remove or reposition members’ dinghies, sailboards or other equipment should it be required.

 

 

2.0    Parking Access Roads

2.1    All motor vehicles shall be parked in the car park in accordance with any instructions given by The Committee.  No car or trailer shall be parked on or obstruct the access roads to the Club’s premises or the perimeter road to the Water.  The Club’s roads may be used by cars and trailers for the purpose only of access to the boat parks and Clubhouse and no car or Trailer shall obstruct the Club’s roads, but shall be parked as soon as practicable in the car park.

2.2    The Windsurf Car Parks are exclusively for those members sailing windsurfers, except when signage indicates otherwise during open meetings.

2.3    No motor vehicle shall be used on the Club slipways.

2.4    No boat trailer or launching trolley shall be left on any boat slipway, where practical it should be moved to allow others unrestricted access the water.

2.5    The road access to the Club’s premises and the boat park shall be used one-way in a clockwise direction.

 

 

3.0    Prohibited Activities

3.1    Fishing, shooting, bathing, wading and paddling are prohibited, except when it is necessary to launch or beach boats, or in an emergency.

3.2    No person shall commit or permit any act which might result in pollution or fouling of water in, or flowing into, the reservoir.

3.3    No person shall commit or permit any act which might result in disturbance or harm to any kind of wild life.

3.4    All members of the Club and all visitors shall immediately comply with any reasonable instructions or requirements of the Water Authority officers and servants necessary to safeguard The Authority interests as statutory water undertakers.  No member or visitor shall enter on any of the Water Authorities lands outside the Club’s premises other than for the purpose of travelling to and from the Club’s premises over the access and perimeter roads.

 

 

4.0    Abandoned Boats on Club Premises

4.1    If at any time any Boat Fees payable to the Club by any Member or former Member shall be one month in arrears:

 

a)      The Committee shall be entitled to move the boat to any other part of the premises without being liable for any loss of or damage to the boat howsoever caused.

b)      The Committee shall be entitled upon giving one month’s notice in writing to the Member or former Member, at the last known address shown in the register of Members to sell the boat and to deduct any monies due to the Club, (whether by way of arrears of subscriptions or Boat Fees or otherwise from the net proceeds of sale before accounting for the balance (if any) to the Member or former Member.

c)       Alternatively, any boat which in the opinion of the Committee cannot be sold may, upon such notice as aforesaid, be disposed of in any manner The Committee may think fit and the expenses recovered from the Member or former Member.  Any arrears as aforesaid shall be deemed to be a debt owing to the Club by the Member or former Member.  Further, the Club shall at all times have a lien over Members’ boats parked or moored on the Club’s premises or Club moorings in respect of all monies due to the Club, whether in respect of arrears of Boat Fees or subscriptions or otherwise.


5.0    Use of Water

5.1    All yachts and sailboards whilst on the water whether racing or not shall comply with the current Sailing Instructions.

5.2    Registration Fees

No craft shall be brought to the Club’s premises or be taken afloat unless it is registered with the Club and the appropriate registration fee for the current year has been paid.  The craft is insured for a minimum of £2,000,000 against third party risks.

5.3    Boat Sticker/Sailboard Tag

Whilst on the water all boats shall display current boat sticker and all sailboards a current tag.

5.4    Racing

Racing will take place under the current Racing Rules of Sailing (RRS), the prescriptions of the RYA, the Sailing Instructions and the appropriate class rules.

5.5    Personal Buoyancy

Personal buoyancy will be worn at all times while on the water (wet suits or waist/seat harnesses alone are not deemed to be personal buoyancy).  If solely of the inflatable type, personal buoyancy must be fully inflated. Windsurfers who have completed self certification do not have to wear buoyancy aid but must carry a means of signalling distress.

5.6    Insurance

All craft must be insured against third party risks for a minimum stated in the current Sailing Instructions.

5.7    Responsibility for Craft

The safety of any craft and its entire management including insurance shall be the sole responsibility of the owner and/or competitor sailing the craft.  The establishment of these rules in no way limits or reduces the complete responsibility of the owner and/or the competitor for his crew, his craft and the management thereof.

5.8    Prohibited Areas

Sailing is not permitted within 100 feet of the shore except for access to the Club compound and the public access areas.  Landing in the prohibited areas is allowed only in an emergency.  During the fishing season the buoyed area in Toft Bay and 250 feet from Draycote Bank are prohibited areas.  Any yacht infringing this regulation may be disqualified.  The pontoon is to be used only by the committee boats and rescue craft.

 

6.0 Affiliated Groups

6.1 Members of Affiliated groups shall be entitled to sail at times agreed for their group. Only members of such group whose names are registered with The Club shall be entitled to visit the Club’s premises or to sail on The Water and such members shall at all times conform with the conditions of Affiliation published by the Committee from time to time.

6.2 Not more than four members per registered boat and one member per registered sailboard together with the day leader shall be present on the Club site at any one time.

6.3 A nominated leader/day leader of such affiliated groups, approved by the Committee, shall be present at all times when members of the group are on the Club’s premises.  He shall be responsible for the observance of these Regulations and any instructions of the sailing sub-committee of the Club as if he were acting as Duty Officer of the Club (nominated leader/day leader will normally be officers of their own Club and must be proven capable of handling a club dory and be a holder of a recognised first aid certificate).

6.4 The Group leaders shall sign on as being responsible for the safety of the group, in the book provided and shall enter time of arrival and departure.

6.5 The boat, car stickers and logos, which are issued by the Club Secretary, shall be displayed at all times whilst on the Club site.

6.6 Nominated leaders shall at all times whilst on the Club site, carry the membership card issued by the secretary.

6.7 During the normal Club sailing times, the Leader in charge must report to the Club D.O. before boats are launched.

6.8 Rescue craft are for use in emergency only.  They are to be left at the pontoon when not so engaged or unless safety dictates otherwise.

6.9 At all times when the Clubhouse is not fully open for use of Draycote Water Sailing Club members (for example when no D.O. is provided by the Club) use of the Clubhouse facilities is restricted to the Race Office, changing rooms and Wet Bar.

6.10 Affiliated group members may not bring guests without the consent of the Committee.

6.11 Craft shall be parked only in areas specified by the General Committee.

6.12 All craft must be clearly identified with its group name.

6.16 Payment of the Affiliated Fee constitutes acceptance of the above Conditions of Affiliation and all the Rules and Regulations of the Club and are payable by 31st March each year.

 


7.0    Special regulations for Affiliated Groups engaged in canoeing.

 

All the regulations above are applicable to all affiliated groups engaged in canoeing, except as modified in 7.1.

 

7.1    Modifications

7.1.1           Rule 3.1 ADDITION – swimming is permitted for the sole purpose of safety training and self rescue.

7.1.2           Rule 5.1 does not apply.

7.1.3           Rule 5.2 does not apply.

7.1.4           Rule 5.3 does not apply.

7.1.5           Rule 5.4 does not apply.

7.1.6           Rule 5.6 does not apply.

7.1.7           Rule 5.7 does not apply.

7.1.8           Rule 6.2 does not apply.

7.1.9           Rule 6.3 SUBSTITUTE LAST SENTENCE – (Nominated leader/day leader will be a qualified Senior Instructor of the B.C.U. or Duty Instructor nominated by the Affiliated Canoeing Group with holders of a recognised first aid certificate in attendance).

7.1.10       Rule 6.6 SUBSTITUTE – Canoe Club members at all times whilst on Club premises shall carry a Canoe Club membership card.

7.1.11       Rule 6.13 does not apply.

7.1.12       Rule 6.14 does not apply.

7.1.13       Rule 6.15 does not apply.

 

7.2    The B.C.U. rules regulating the numbers of those canoeing shall be observed at all times.

7.3    Affiliated Canoeing Groups shall operate within the safety regulations prescribed by the B.C.U.
